The United States of America (USA) has been applying countervailing duty measures and anti-dumping measures against imports of large-diameter welded pipe (HS Codes 7305.11, 7305.12, 7305.19, 7305.31, and 7305.39) from Türkiye since 2019.
According to the relevant US legislation, the existence of dumping/subsidy and whether Turkish steel pipes harm US domestic production is being examined. In this process, the responses of the Turkish government and exporters to the US authorities will determine the course of the investigation. According to the results of the investigation, it will be determined whether the existing countervailing duty measures will continue.
Turkish steel pipe producers and exporters should be prepared to closely follow the process and take the necessary actions.
The Turkish Steel Exporters' Association said; "Two separate investigations are being conducted by the International Trade Administration (ITA) of the US Department of Commerce into the existence of dumping and subsidy and by the International Trade Commission (ITC) into whether the existing dumping and subsidy practices have damaged US domestic production.
A final review investigation (sunset review) has been initiated by the aforementioned US institutions for the anti-dumping and countervailing duty measures applied to imports of large-diameter welded pipe originating in Türkiye with the notifications published in the Official Gazette of the US dated 1 February 2024.
In this respect, those who would prefer to become a party to the investigation to be conducted by the ITA, which will assess the existence of dumping/subsidies, are required to contact the ITA and submit their intention to become a party to the investigation in writing no later than 1 February 2024. Following becoming a party, interested parties have 30 days from 1 February 2024 to submit "complete substantive responses". After becoming a party, they are required to submit to the US authorities by answering the questions in the US legislation 19 CFR 351.218 (d)(3) within 30 days after 1 February 2024). In addition, those who wish to be a party to the investigation to be carried out by the ITC, which will evaluate the existence of damage, are required to contact the ITC within 21 days after 1 February 2024 and submit their intention to be a party to the investigation in writing, and they must answer the questions published in the attached Official Gazette of the US and submit them to the ITC until 4 March 2024.
