A Presidential decree regarding some measures taken in the field of disaster and emergency management under the State of Emergency was published in today's Official Gazette.
The decree stated that "Owners of residential, commercial, and barn buildings that have been identified as collapsed or heavily damaged in the disaster areas will not be required to have TCIP for the construction or provision of credit, provided that they are eligible and indebted as disaster victims, in accordance with the provisions of Law No. 7269."
Furthermore, the decree stated that "Restrictive provisions will not be applied regarding the recognition of the owners of buildings who construct buildings without obtaining a construction permit on lands they do not own or in areas designated as unsuitable for construction in the zoning plan, in the reconstruction or provision of credit for residential, commercial, and other buildings."
The announcement will be made for the application for ownership rights
In disaster areas, the announcement regarding ownership rights applications for those who want to obtain construction loans or build a building will be published on the website of the Disaster and Emergency Management Presidency. The owners must apply within 2 months from the announcement date. If necessary, this period can be extended for a maximum of 1 month.
The results of the application will be announced on the website of the Disaster and Emergency Management Presidency and the e-Government portal by the relevant provincial authorities. Those whose ownership rights are not accepted can object within 15 days.
The necessary statements and contracts will be exempted from any taxes, fees, participation fees, and charges
The purchase, sale, mortgage, land registry and cadastral transactions of real estate required for the implementation of projects to be financed by credits and grants from international organizations will be exempt from any taxes, fees, participation fees, and charges related to the necessary statements and contracts.
Projects developed for earthquake-stricken areas will be exempt from all kinds of taxes
Within this scope, in national and international projects carried out, the Ministry of Commerce may allow the import of prefabricated, container and temporary housing materials, building materials, machinery, motor vehicles, equipment and supplies, spare parts, and aid materials to be used in disaster and emergency situations. Additionally, goods deemed appropriate for import will be exempt from customs duties and any taxes, fees, funds, and other financial obligations collected with this tax.
In order to remedy the damage caused by earthquakes as much as possible, projects financed by loans and grants that can be obtained from international organizations will be exempt from taxes, fees, participation fees, and charges. In this case, the purchase, sale, mortgage, title deed, and cadastre procedures of real estates within the scope of project implementation will be exempt from all taxes.
