It was decided that earthquakes based in Kahramanmaraş would be considered as "force majeure" in terms of some term obligations of legal entities holding associate licenses or production licenses in the electricity market and real and legal persons holding licenses and certificates in the natural gas market.
In this context, as of 6th February, the pre-license periods and the pre-construction period within the scope of the production license and the postponement periods of the obligation under the temporary Article 15 of the Regulation, except for the applications for the storage electricity generation facility and the pre-construction period and the periods given for the completion of the necessary information and documents within the scope of the pre-license applications and amendment applications, to be applied throughout the country during the state of emergency (State of Emergency) as of February 6, the periods related to the obligations determined within the scope of the preliminary license or production license amendment procedures, the periods related to the obligations determined within the scope of the merger or division transactions, the periods related to the obligations determined within the scope of the issuance of the production license as a continuation of the old one, the periods related to the obligations determined within the scope of the issuance of the production license to the legal entities that have expired or will expire, effective from the date of termination, shall be considered as extended for the duration of the State of Emergency without the need for any transaction, and the relevant main service office will be authorized in this regard.
In addition, legal entities holding production licenses subject to electricity generation facilities planned or partially in operation in provinces where a state of emergency decision has been taken or declared a disaster zone and legal entities holding production licenses whose company is headquartered in these provinces will be exempted from the obligation to submit a progress report within the scope of the second paragraph of Article 52 of the Regulation during the state of emergency.
On the other hand, earthquakes centered in Kahramanmaraş were also considered as "force majeure" in terms of the periodic obligations of real and legal persons holding licenses and certificates in accordance with Article 46 of the Natural Gas Market Licensing Regulation and Article 24/B of the Natural Gas Market Certificate Regulation.
