European Commission published the final regulation for the CBAM transition process

Last week, the European Commission published the final regulation for the implementation of the transition phase of the new Carbon Border Adjustment Mechanism (CBAM).

The CBAM transition phase will start at the beginning of October 2023 and continue until the end of 2025. CBAM will be fully implemented from 2026.

The final regulation published last week clarified all aspects of implementation during the transition period. A CBAM Transition Register has been set up by the European Commission and additional IT tools as well as materials have been developed to support the transition process.

The published regulation states that "During the transition period, importers or their indirect customs agents shall report the quantity of products imported, the direct and indirect emissions contained in those products and the carbon prices to be paid for those emissions, including the carbon prices to be paid for emissions contained in the relevant precursor substances. The first report must be submitted by 31 January 2024 for products imported in the fourth quarter of 2023. The final report must be submitted by 31 January 2026 for products imported in the fourth quarter of 2025."
