ERDEMİR made a statement regarding the Tata Steel case

Eregli Iron and Steel Factories T.A.Ş. (EREGL), Tata Steel International (North America) Ltd. made a statement to the Public Disclosure Platform regarding the lawsuit filed by the company. The litigation between the two companies had been going on for several years.

The statement made to the Public Disclosure Platform, titled "Information Regarding the Lawsuit filed by Tata Steel International (North America) Ltd. (formerly Corus International Trading Ltd.) Company", is as follows:

"A contract has been concluded between our Company and Corus International Trading Ltd. Company -the new title Tata Steel International (North America) Ltd.-, headquartered in Illinois, United States of America, in 2008. Our company has completed all its obligations arising from this contract in January and February 2009. Corus International Trading Ltd. Company sold the products it procured from our Company to third parties, but later claimed that some compensation claims were made by them and that some of these claims should be met by Erdemir. could not reach an agreement and subsequently Corus International Trading Ltd. Company filed a compensation lawsuit against our Company in the Illinois State District Court, together with its associates, amounting to USD 4.800.000.00. has been made.

After the said case was rejected by the court in terms of jurisdiction; this time Tata Steel International (North America) Ltd. The lawsuit has been reopened by the Company in the District Court of the State of Texas. PDP statement regarding this situation was made by our Company on 24.08.2011; if the relevant case is again rejected by the court in terms of jurisdiction; It was announced to the public with PDP statements on 16.07.2012.

Corus International Trading Ltd. Company - new title Tata Steel International (North America) Ltd. It was learned with the notification made to our Company on 31.10.2012 that a compensation lawsuit was filed against our Company with the same claims and demands, amounting to 8,668,800 TL (4,800,000,00 USD) against our Company at the 14th Commercial Court of First Instance. .

As a result of the trial, the Court decided to dismiss the case due to lack of jurisdiction and sent the file to the Karadeniz Ereğli 2nd Civil Court of First Instance. At the hearing of the ongoing case on 28 November 2017, Kdz. Ereğli 2nd Civil Court of First Instance decided to partially accept the case against our Company; Our company has applied to appeal against the said decision.
With the decision of the 22nd Civil Chamber of the Ankara Regional Court of Justice, Kdz. The decision of the Ereğli 2nd Civil Court of First Instance was annulled and the file was sent to Kdz. It was sent to the Ereğli 2nd Civil Court of First Instance. At the hearing held on February 22, 2022, it was decided that the case be partially accepted and partially rejected, with the way of appeal being open. On 13.04.2022, our Company appealed against the said decision.

The 22nd Civil Chamber of the Ankara Regional Court of Justice decided to cancel the court decision without examining the merits and to send the file to the court in order to write the appropriate justification in the judgment part. Kdz. Ereğli 2nd Civil Court of First Instance decided to accept the case partially, with the way of appeal open. Our company has appealed against the said decision.”
